The Supreme Court upheld the levy of GST on lotteries, holding that the inclusion of actionable claims such as lottery, betting and gambling within the definition of 'goods' under Section 2(52) CGST Act is constitutionally valid and not discriminatory. A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
How we apply it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.
Notification No. 44/2019-Central Tax dated 09.10.2019 · 2019-10-09
This notification prescribed that the return in FORM GSTR-3B for each of the months from October 2019 to March 2020 was to be furnished electronically on or before the twentieth day of the month succeeding the month concerned, and that the tax due had to be discharged by debiting the electronic cash or credit ledger not later than the same date. It continued the practice of notifying GSTR-3B due dates in six month blocks.
Practical effect: The twentieth of the following month remains the familiar GSTR-3B deadline for larger Chennai taxpayers, and payment must accompany the return, not follow it.
