GSTN Advisory, November 2024 — 30-day IRP reporting limit for AATO Rs 10 crore and above · 2024-11

GSTN advised that from 1 April 2025, taxpayers with annual aggregate turnover of Rs 10 crore and above cannot report e-invoices on the Invoice Registration Portals beyond 30 days from the document date. The restriction, earlier applicable only to very large taxpayers of Rs 100 crore and above, covers invoices, credit notes and debit notes. The IRP validation simply rejects documents older than 30 days, so late reporting becomes impossible.

Practical effect: Automate same-day or same-week IRN generation, because an invoice missed beyond 30 days cannot be e-invoiced at all and endangers the buyer's ITC.

37th GST Council Meeting, Goa — 20 September 2019 · 2019-09-20

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST. Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months).
