The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

Why this matters: Tamil Nadu was one of only two States selected for this pilot, though the scheme was never rolled out in practice.

The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
Is there a late fee for filing GSTR-1 after the 11th?
Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Although the portal historically collected GSTR-1 late fees through the next GSTR-3B, the liability arises the moment the due date passes. Delayed GSTR-1 also hurts your customers, because your invoices miss their GSTR-2B and their input tax credit gets deferred, which can strain business relationships. Filing by the 11th every month avoids both the cost and the friction.
Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Our institute charges one fee covering classes, study material and hostel. How is it taxed?
A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. For a coaching institute, coaching is the principal supply, so the entire lump sum, including printed materials and boarding provided as part of the package, attracts 18 percent. Printing separate invoices for books at nil rate out of a bundled fee is a known audit red flag and is routinely rejected. If the institute genuinely sells optional printed books to anyone at a separate price, those standalone sales can take the book's own treatment. Structure the fee schedule deliberately, not after the demand arrives.
We are constructing our own office building in Vyasarpadi. Can we claim ITC on the materials and contractor bills?
No. Section 17(5)(c) and (d) block credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, which covers apparatus and equipment fixed to earth by foundation or structural support, but expressly excludes land, buildings, telecom towers and pipelines laid outside the factory. Note that the Finance Act 2025 retrospectively substituted the phrase plant or machinery with plant and machinery from 1 July 2017, neutralising the wider reading taken in the Safari Retreats ruling. I received an intimation in DRC-01C about ITC mismatch. How do I respond?
DRC-01C is issued under Rule 88D when the ITC claimed in your GSTR-3B exceeds the ITC available in GSTR-2B beyond the permitted limits. You must respond within seven days, either by paying the excess with interest through DRC-03 or by explaining the difference in Part B of DRC-01C, citing valid reasons such as credits of earlier periods claimed within time, reclaims after Rule 37 payment, or import ITC not flowing through 2B. Until you respond, the portal can block filing of your next GSTR-1. Do not ignore the seven-day window; call +91 - 9600 606 444 the day it arrives.
What is the late fee for filing GSTR-9 after the due date?
From FY 2022-23 onwards, the late fee is turnover-linked. For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. The fee accrues until the date of filing, so delays get expensive for larger businesses. Filing before 31 December avoids the entire cost.
Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable. Is GST payable on hostel or paying guest accommodation in Vyasarpadi?

Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
Does compensation cess still apply on any goods?
For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate. The cess continues only on pan masala and specified tobacco products during the transition period while past compensation cess loan obligations are being discharged. A practical point for traders: balances of unutilised compensation cess credit cannot be cross-utilised against CGST, SGST or IGST liability, so businesses holding old cess credit should evaluate their position rather than assuming it will set off future tax.
