RSB Transmissions (India) Ltd v. Union of India — Jharkhand High Court, judgment dated 18 October 2022 · 2022-10-18

The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.

What it means for you: Depositing cash into the ledger early does not protect you from interest — the GSTR-3B must actually be filed on time.

If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
How exactly do I pay RCM in my return and claim it back as credit?
Report the taxable value and tax in Table 3.1(d) of GSTR-3B; this liability must be discharged in cash through the electronic cash ledger, because input tax credit cannot be used to pay reverse charge dues. In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. RCM invoices from registered suppliers like GTAs appear in GSTR-2B, but credit for unregistered-supplier RCM rests on your self-invoice, and Circular 211/5/2024 confirms the Section 16(4) deadline runs from the year of that self-invoice. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion.
