The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.

What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Beyond that, the demand becomes recoverable. Several traders in Vyasarpadi have faced bank account attachment for ignored GSTR-3A notices, so act within the fifteen-day window.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?

Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. Without this mapping, recovery notices can continue despite full payment, so businesses in Vyasarpadi with paid-but-open demands should file DRC-03A promptly.

When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in Vyasarpadi use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?

Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent. Most professional, business support and repair services billed by professional firms continue at 18 percent with full input tax credit.
Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent.
