I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. The cess continues only on pan masala and specified tobacco products during the transition period while past compensation cess loan obligations are being discharged. A practical point for traders: balances of unutilised compensation cess credit cannot be cross-utilised against CGST, SGST or IGST liability, so businesses holding old cess credit should evaluate their position rather than assuming it will set off future tax.
How is interest calculated on a GST demand or late payment?
Interest runs at 18 percent per annum under Section 50 on tax paid after the due date, computed day-wise from the day following the due date until payment. Following amendments, interest on delayed GSTR-3B liability applies on the portion paid through the electronic cash ledger, and interest on wrongly availed ITC arises where the credit has been both availed and utilised.
