The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.
Practical effect: Tamil Nadu's textile and footwear clusters faced a five to twelve per cent increase from January 2022, a decision the Council reversed for textiles on 31 December 2021, the eve of implementation.
Notification No. 5/2017-Central Tax (Rate), dated 28 June 2017 · 2017-06-28
Issued under the proviso to Section 54(3), this notification names goods whose suppliers may not claim refund of input tax credit accumulated because inputs are taxed higher than outputs. The original list covered specified woven and knitted fabrics and certain railway goods. The restriction on fabrics was lifted from 1 August 2018, but credit lying unutilised on that date was made to lapse, and the notification continues to block refunds for the goods still listed in it.
What it means for you: Before filing an inverted duty refund, check whether your finished goods appear in this list, because a refund claim on a blocked item will be rejected and may invite penalty.

The Appellate Authority upheld that classification.
