This was the first notification issued under the CGST Act. A consignment of power weeders was intercepted on 6 March 2023 at about 10.30 a.m., the e-way bill having expired at 11.59 p.m. the previous night. The taxpayer pleaded a vehicle breakdown. The Court declined to interfere, noting that the validity could have been extended within the permitted window and had not been, and that the officer's decision to detain and penalise under Section 129(1) was not unreasonable. The writ petition was dismissed with liberty to file a statutory appeal.

What is the late fee if I file a nil return late?
For a nil GSTR-3B or nil GSTR-1 filed after the due date, the late fee is Rs.20 per day of delay (Rs.10 CGST plus Rs.10 SGST), capped at Rs.500 per return (Rs.250 plus Rs.250). No interest applies since there is no tax payable. While Rs.500 sounds small, defaults across several months add up, and the bigger cost is the compliance chain breaking and your GSTIN being flagged. How and when can I opt in or out of the QRMP scheme?

I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?
Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation.
