GSTR-3B introduced as a stopgap return for the first two months

Responding to trade concerns about return readiness, the Council decided that for the first two months of GST, tax would be payable on a simple summary return, Form GSTR-3B, filed by the 20th of the following month. Invoice-wise details in GSTR-1 for July 2017 were to be filed between 1 and 5 September and for August between 16 and 20 September, with GSTR-2 auto-populated thereafter. This is the origin of the summary return that has governed monthly GST compliance ever since.

What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. Section 17(5) blocks credit on specified items regardless of business use: motor vehicles for passenger transport with seating up to thirteen persons, unless used for resale, passenger transport or driver training; food and beverages and outdoor catering; club and fitness memberships; life and health insurance except where statutorily obligatory; works contract and construction services for immovable property other than plant and machinery; goods lost, stolen, destroyed, written off or given as gifts and free samples; and tax paid under composition. I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
How do I file a nil GSTR-3B by SMS?
From the mobile number registered as authorised signatory, send an SMS to 14409 in the format NIL space 3B space your GSTIN space tax period in MMYYYY format. The portal replies with a six-digit verification code; confirm by sending CNF space 3B space the code to 14409. You receive an ARN on successful filing. SMS filing works only if the return is genuinely nil, meaning no outward supplies, no liability of any kind, and no pending returns for earlier periods. If the SMS route fails, we can file it online for you the same day.
Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
Which everyday goods now attract 5 percent GST?
