Quarterly Return Monthly Payment scheme opened to turnover up to Rs 5 crore

Notification No. 84/2020-Central Tax · 2020-11-10

Registered persons whose aggregate turnover in the preceding financial year was up to Rs 5 crore, and who had filed the return for the preceding month, were notified as eligible to furnish GSTR-3B quarterly while paying tax monthly. The option is exercised on the common portal for each quarter within a specified window, and once exercised it continues for future periods until it is changed. Crossing Rs 5 crore during a year makes the person ineligible from the next quarter.

Check the agency's constitution. Is there a last date to claim input tax credit for a financial year?
Yes. Under Section 16(4), ITC for invoices and debit notes of a financial year must be claimed by the earlier of 30 November following the end of that financial year or the date of filing the annual return GSTR-9. So credit on a March 2026 invoice must be taken in a GSTR-3B filed on or before 30 November 2026. Credits discovered after this date are permanently lost, which is why a year-end reconciliation in September or October, comparing books, GSTR-2B and GSTR-3B for the full year, is essential for every business in Adambakkam.
What counts as exempt supply when calculating my ITC reversal ratio?

Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
My shop's landlord in Adambakkam is not GST registered. Do I pay GST on the rent myself?
Yes, if you are registered. With effect from 10 October 2024, renting of any immovable property other than a residential dwelling by an unregistered person to a registered person was notified under reverse charge, so a registered tenant must pay 18 percent on the rent in cash through GSTR-3B and can claim ITC subject to the usual conditions. Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect. Distributor incentive schemes run from Adambakkam should be papered before the season starts, not after.
Does compensation cess still apply on any goods?

Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
