Refund tightened: no rate-change inversion claims and credit limited to GSTR-2A

Circular No. 135/05/2020-GST dated 31 March 2020 · 2020-03-31

This circular made four significant changes. Refund claims cannot be bunched across financial years. Refund of accumulated credit on account of an inverted duty structure is not available where the inversion arises only because the rate on the same goods was reduced over time, since input and output are the same. Refund of tax paid on supplies other than zero-rated is repaid proportionately in cash and credit. Most importantly, refund of accumulated credit is restricted to invoices actually reflected in the applicant's GSTR-2A, and HSN or SAC must be shown in Annexure-B.

Practical effect: Refund working papers must now tie back to GSTR-2A invoice by invoice, and traders whose stock simply became cheaper cannot claim an inverted-duty refund.

The Court allowed the refund, holding that Section 54(3) covers unutilised credit of a unit making zero-rated supplies, and that the second proviso to Rule 89 restricting claims to the supplier applies only to direct supplies to an SEZ, not to distributed credit.
