Bharat Raj Punj v. Commissioner of Central Goods and Service Tax — Rajasthan High Court, Jaipur Bench, S.B. Criminal Writ Petition No. 76 of 2019, judgment dated 12 March 2019 · 2019-03-12
The petitioner argued that no arrest or prosecution could follow without first determining the tax liability under Sections 73 or 74. The High Court rejected this, holding that for an offence under Section 132 determination of tax is not required and the department may proceed directly by issuing summons, or by arrest where reasonable grounds exist. The Court distinguished cases of mere non-payment of collected tax from the fraudulent availment of credit on fake invoices alleged here.
Practical effect: Where fake invoices are alleged, do not assume the absence of an assessment order protects you from criminal proceedings.
Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
What to do about it: The late fee waiver here is conditional: if the GSTR-3B was not filed by the notified date, late fee runs from the original due date, so the actual filing date decides whether any waiver survives.
35th GST Council Meeting, New Delhi — 21 June 2019 · 2019-06-21
At the first meeting chaired by Finance Minister Nirmala Sitharaman, the Council decided to introduce an electronic invoicing system in a phase-wise manner for business-to-business transactions. The press release recorded that e-invoicing would help taxpayers with backward integration and automation of tax-relevant processes and would help authorities combat evasion, with Phase 1 proposed to be voluntary and rolled out from January 2020. This decision is the origin of the Invoice Registration Portal, the IRN and the QR code now mandatory for most mid-sized and large businesses.
Why this matters: Every later e-invoicing threshold reduction, down to the Rs 5 crore limit now applicable, traces back to this decision, so businesses crossing a threshold must set up e-invoicing from the first day of the next financial year.
