Mr. Kannippan Arumugan v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 2943 of 2026, decided 30 January 2026 (C. Saravanan J.) · 2026-01-30

The taxpayer had reported tax of Rs 2,54,040.30 against an invoice instead of the correct Rs 1,31,280.30, and a demand followed. The Court quashed the assessment order dated 21 July 2025 and remitted the matter for fresh adjudication within six months, permitting the petitioner to rectify the inadvertent error subject to compliance with Circular No. 212/6/2024-GST, and directing the officer to verify with the recipient's jurisdiction whether excess credit had in fact been availed.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

How does a GTA opt for forward charge, and by when must it be done?

Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
How should I raise invoices on foreign clients and report them in my returns?
You may invoice in foreign currency, but your GST records must state the value in rupees. An export invoice under LUT should carry the endorsement that the supply is meant for export under Letter of Undertaking without payment of integrated tax, along with your GSTIN, SAC code and the recipient's overseas address. In GSTR-1, these invoices go into Table 6A marked without payment of tax, and the turnover flows into GSTR-3B as zero-rated supplies. Match every invoice to a FIRC or bank credit. How do I file a nil GSTR-3B by SMS?
From the mobile number registered as authorised signatory, send an SMS to 14409 in the format NIL space 3B space your GSTIN space tax period in MMYYYY format. The portal replies with a six-digit verification code; confirm by sending CNF space 3B space the code to 14409. You receive an ARN on successful filing. SMS filing works only if the return is genuinely nil, meaning no outward supplies, no liability of any kind, and no pending returns for earlier periods. I claimed some ITC wrongly last year. What interest and penalty apply if I reverse it now?
Under Section 50(3) as amended, interest at 18 percent per annum applies where wrongly availed credit has also been utilised, calculated from the date of utilisation until reversal; credit that was availed but never utilised, because your ledger balance never fell below the wrong amount, attracts no interest. Voluntary reversal is done through GSTR-3B or by payment in DRC-03, and paying before any show cause notice generally avoids or minimises penalty. How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation.
