It sought exemption on the footing that this was renting of residential accommodation. The taxpayer was fastened with a demand arising from discrepancies between GSTR-1 and GSTR-3B without being issued a scrutiny intimation in Form ASMT-10. The Madras High Court held that when proceedings originate from scrutiny of returns under Section 61, issuance of ASMT-10 pointing out the discrepancies and seeking an explanation is a mandatory first step; bypassing it vitiates the subsequent assessment. The order was set aside and the matter remitted for fresh action in accordance with law.
