Exemption for fresh fruit and nuts covers only produce that has not been dried; once dried, they move to the taxable schedule. Tamarind seeds, copra as distinct from edible coconut, pure mehendi paste without additives, scented and flavoured sweet supari, brewers' spent grain and distillers' grains were each assigned a rate, and the position on renewable energy project valuation was restated.

34th GST Council Meeting (video conferencing) — 19 March 2019 · 2019-03-19
The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.
What it means for you: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.
Eicher Motors Ltd v. Superintendent of GST and Central Excise — Madras High Court, 2024 · 2024-01-23
Eicher Motors had deposited tax amounts into its electronic cash ledger before the due dates but filed GSTR-3B belatedly owing to transitional credit issues, and the department demanded interest under Section 50. The Madras High Court held that once the amount is credited to the Government via the electronic cash ledger by the due date, the tax liability stands discharged to that extent, and no interest is leviable merely because the return was filed late. This reasoning has since been followed by other High Courts.
Practical effect: If cash was parked in your electronic cash ledger before the due date, contest any interest demand for delayed GSTR-3B filing on that amount.
