This early circular resolved several healthcare and accommodation questions. It clarified that room rent charged by a hospital to an in-patient and food supplied to admitted patients as advised by the doctor form part of exempt composite healthcare services, while food sold to attendants and visitors is taxable. The Supreme Court held that the transaction value declared by an importer must ordinarily be accepted. Before rejecting it, the proper officer must have a reasonable doubt based on certain material and specific reasons, must communicate those grounds to the importer, and must give an opportunity to explain. A mere suspicion, or reliance on price data without disclosure, is not sufficient to displace the declared value.
