Imitation zari thread or yarn made from metallised polyester or plastic film was placed at five per cent, and past periods were regularised on an as-is basis.

What to do about it: Snack and zari manufacturers in and around Chennai got both a lower rate and protection for past periods, so old demands on these items should be contested with this circular.

Madras High Court: no Section 50 interest where tax was deposited in the electronic cash ledger by the due date

Eicher Motors Ltd v. Superintendent of GST and Central Excise — Madras High Court, 2024 · 2024-01-23

Eicher Motors had deposited tax amounts into its electronic cash ledger before the due dates but filed GSTR-3B belatedly owing to transitional credit issues, and the department demanded interest under Section 50. The Madras High Court held that once the amount is credited to the Government via the electronic cash ledger by the due date, the tax liability stands discharged to that extent, and no interest is leviable merely because the return was filed late. This reasoning has since been followed by other High Courts.

Mandatory HSN reporting in Table 12 of GSTR-1 was introduced in phases from 1 April 2022, when the portal began flagging missing or short codes in warning mode. In Phase-II, from the November 2022 return period, taxpayers with annual aggregate turnover up to Rs 5 crore had to report at least four-digit HSN codes for all business-to-business supplies in Table 12, and taxpayers above Rs 5 crore had to report six digits for all supplies. Phase-III in 2025 went further and replaced manual entry with selection from a dropdown of valid codes.

Second, where providing the facility is obligatory for the employer under any law, credit is allowed; the classic case is a statutory canteen required under the Factories Act for factories employing more than 250 workers. Even then, credit is typically restricted to the cost borne by the employer, not amounts recovered from employees. Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
