Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.

The window for taking the benefit of the capped late fee on pending GSTR-3B returns for July 2017 to April 2021 was extended from 31 August 2021 to 30 November 2021. Response to the scheme had been strong but many taxpayers, particularly those whose registrations had been cancelled for non-filing, could not complete the exercise in three months. The extension was announced together with the extension of the revocation deadline so that the two reliefs could be used in sequence.

The Supreme Court held that mobile telecom towers and prefabricated shelters are not immovable property. They are fixed to the earth only for stability, can be dismantled and relocated without damage, and are therefore intrinsically movable goods. Consequently they qualify as capital goods or inputs and CENVAT credit on them is allowable. The reasoning on the movable versus immovable test is regularly applied to input tax credit disputes under GST as well.

What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
How will I be informed of the GST audit findings?
On conclusion of the audit, the officer must inform you of the findings, your rights and obligations, and the reasons for the findings in Form ADT-02 within thirty days. Before that, most audit teams share draft observations and seek your response, which is your best window to knock out weak points with documents. If the audit detects unpaid tax or wrongly availed ITC, you can accept and pay through DRC-03, or contest, in which case the department initiates proceedings under Section 73 or Section 74. Treat the draft objection stage seriously; a strong rebuttal there often prevents a show cause notice altogether.
I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases.
