The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. The dominant nature test was applied to decide the character of the contract.
Practical effect: Chennai businesses with bundled offerings should determine the dominant character of the supply, since that decides classification and rate under GST.

Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.
Practical effect: Chennai restaurants listed on delivery platforms must separate platform sales from direct sales in their records, because the tax on the former is paid by the platform.
Notification No. 18/2025-Central Tax — insertion of Rules 9A & 14A, effective 1 November 2025 · 2025-10-31
Implementing the 56th GST Council decision, CBIC inserted Rule 9A, enabling risk-based automatic electronic grant of registration within three working days for low-risk applicants, and Rule 14A, an optional simplified route for small applicants who self-assess their monthly output tax liability on supplies to registered persons at not more than Rs 2.5 lakh, with Aadhaar authentication mandatory. The scheme is expected to cover the large majority of new registration applications and reduce officer-interface delays.
Practical effect: Genuine small businesses in Chennai can now expect a GSTIN within about three working days by opting for the Rule 14A route with Aadhaar authentication.
