A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Practical effect: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
I generate e-invoices. Do I still have to prepare GSTR-1 separately?
If your aggregate turnover exceeds Rs.5 crore, e-invoicing is mandatory and the invoice details reported to the Invoice Registration Portal auto-populate into your GSTR-1. However, auto-population is not a substitute for review. B2C sales, exports without IRN issues, credit notes, amendments and advances still need to be verified or added manually before submission. What is the difference between GSTR-2A and GSTR-2B, and which one should I follow?
GSTR-2A is a dynamic statement that keeps changing as suppliers file or amend their returns, so the same month's data can look different on different dates. GSTR-2B is a static statement generated on the 14th of each month, capturing supplier filings between cut-off dates, and it never changes afterwards. The law ties your ITC eligibility to GSTR-2B, and GSTR-3B auto-populates from it, so 2B is the statement to reconcile against for monthly claims. GSTR-2A remains useful for tracing when an invoice was actually uploaded, which helps in replying to departmental queries about earlier periods.
I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
What is the last date to file GSTR-9 for a financial year?
GSTR-9 for a financial year is due by 31 December of the following financial year. For example, the annual return for FY 2024-25 is due by 31 December 2025, unless the government extends the date by notification. The reconciliation statement GSTR-9C, where applicable, has the same due date and is filed after GSTR-9. What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Transfer of development rights and long-term leases to promoters are also covered.
