This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
Practical effect: The late fee waiver here is conditional: if the GSTR-3B was not filed by the notified date, late fee runs from the original due date, so the actual filing date decides whether any waiver survives.

CBIC again invoked Section 168A to extend the time for passing orders under Section 73(10) to 30 April 2024 for FY 2018-19 and 31 August 2024 for FY 2019-20. The notification has been challenged in several High Courts on the ground that it was issued without a prior GST Council recommendation and without any subsisting force majeure, and the validity question is presently before the Supreme Court, with many demand orders kept alive subject to the outcome.
Why this matters: Demands for 2018-19 and 2019-20 passed under this extended timeline should be defended on merits while also preserving the limitation objection, since the notification's validity is still open.

During a search and investigation the officers pressed the taxpayer to reverse credit and pay tax before any notice was issued. The High Court held that Section 74(5) merely gives the taxpayer an option to pay voluntarily; it does not empower officers to demand or coerce payment before a show cause notice. Raising a demand while the investigation is incomplete was held to be arbitrary and without jurisdiction, and refund of the amounts collected was directed.
