The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

What to do about it: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

Food delivery apps made liable to pay GST on restaurant supplies

Notification No. 17/2021-Central Tax (Rate) dated 18.11.2021 · 2021-11-18

With effect from 1 January 2022, restaurant service supplied through an electronic commerce operator was notified under section 9(5) of the CGST Act. The operator, such as a food delivery platform, became liable to collect and pay the tax on those supplies instead of the restaurant, except where the restaurant is located in specified premises. The same notification also brought passenger transport by omnibus and certain motor vehicles supplied through an operator within section 9(5). Restaurants continue to report such supplies but do not pay tax on them.

Why this matters: A Chennai restaurant selling through a delivery app should show those sales separately in GSTR-3B as supplies on which the operator pays tax, and must not pay tax on them again.

Hospital room rent, patient food and doctors' retention money clarified

Circular No. 32/06/2018-GST dated 12.02.2018 · 2018-02-12

This early circular resolved several healthcare and accommodation questions. It clarified that room rent charged by a hospital to an in-patient and food supplied to admitted patients as advised by the doctor form part of exempt composite healthcare services, while food sold to attendants and visitors is taxable. It also clarified that where a hospital engages senior consultants and retains a share of their fees, the entire consideration charged to the patient is exempt healthcare service. Separately it dealt with hostel accommodation below the then exemption threshold.

Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. Classifying civil costs correctly during a project saves disputes at audit.
When can I issue a GST credit note against my sales invoice?
Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. What is a B2C large invoice and what is the current threshold?

My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. Your Tamil Nadu GSTIN can utilise only IGST, CGST and Tamil Nadu SGST, so another state's CGST and SGST is unusable credit; it will appear in your GSTR-2B but must be excluded from the claim. Options are limited: absorb it as cost, or obtain registration in states with heavy recurring stays, which rarely pays. Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
