Kothari Sugars runs a factory canteen mandated by the Factories Act and recovers a nominal amount from employees, paying the balance to a third-party caterer. The Tamil Nadu AAR, by Order No. 20/AAR/2022 dated 31 May 2022, held that this recovery is consideration for a supply of canteen service and attracts GST, and the Appellate Authority upheld that ruling by its order dated 5 May 2023. The Tamil Nadu position is stricter than rulings in Gujarat and Maharashtra, which treated similar recoveries as non-taxable employee perquisites.
What to do about it: Chennai factories recovering canteen charges from employees should review their GST position, since Tamil Nadu authorities treat even nominal recoveries as taxable.

Meeting shortly after the Kerala floods, the Council discussed that State's proposal to impose a cess on SGST to fund rehabilitation and flood-related works. Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.
What it means for you: This process produced the Kerala flood cess of 2019, the only State-specific GST cess so far, and set the template for how any similar Tamil Nadu levy would have to be approved.
GSTN Advisory, 2023 — e-invoice enablement status and self-enablement on einvoice.gst.gov.in · 2023
GSTN clarified that the enablement status shown on the e-invoice portal is only a system facility and does not decide whether a taxpayer is legally required to issue e-invoices. A taxpayer whose aggregate turnover crossed the prescribed limit in any financial year from 2017-18 onwards must issue e-invoices for business-to-business supplies and for exports, and where the portal does not already show the GSTIN as enabled, the taxpayer can self-enable on the portal. Notified exempt classes such as banks, insurers and passenger transport operators remain outside the requirement.
What it means for you: Test turnover for every year since 2017-18 against the e-invoice threshold and self-enable, because not being enabled on the portal is no defence in an audit.
