A consignment of forty motorcycles carrying valid invoices and e-way bills was intercepted a few kilometres from the delivery point after the driver deviated from the declared route. The officer detained the goods and vehicle and demanded penalty of Rs. 18,96,000. The Madras High Court quashed the detention and penalty, holding the response grossly disproportionate to a minor procedural lapse where there was no attempt to evade tax, and released the goods on payment of a nominal Rs. 5,000.

Practical effect: Where your documents are in order and the only issue is a route deviation or similar technical lapse, a large Section 129 penalty can be resisted as disproportionate.

To revive the residential real estate sector, the Council recommended an effective GST rate of five per cent without input tax credit on residential properties outside the affordable segment, and one per cent without input tax credit on affordable housing, with effect from 1 April 2019. The Council reasoned that buyers would get a fair price, that disputes about builders not passing on credit would become irrelevant, and that unutilised credit which used to become a project cost would be removed.

Why this matters: Flat buyers in Chennai pay one or five per cent on under-construction purchases, but the builder cannot claim input credit, so the tax is embedded in the price rather than shown as recoverable.

Only pan masala, tobacco and related products continued to carry cess after that date, pending discharge of the compensation loan obligations.

No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Can I use my input tax credit balance to pay a DRC-03 liability?

How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days.
