The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Practical effect: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.

Circular No. 179/11/2022-GST · 2022-08-03

The Board settled several goods classification disputes following the 47th GST Council meeting. It confirmed that electrically operated vehicles attract the five per cent rate whether or not they are fitted with a battery pack at the time of supply, and that treated sewage water is exempt because the exclusion for purified water does not extend to it. Tvl. Ranjini Enterprises v. State Tax Officer — Madras High Court (Madurai Bench), W.P.(MD) No. 5172 of 2024, decided 5 March 2024 (B. Pugalendhi J.) · 2024-03-05

A best-of-judgment assessment of about Rs 5 lakh was raised for non-filing of the April 2023 return, the dealer contending that the real liability was about Rs 2 lakh, which was paid once the assessment came to its notice. The Madras High Court permitted the dealer to file an application for condonation of the delay in filing the return and directed the State Tax Officer to consider that application sympathetically in the light of the Court's earlier precedent. The writ petition was disposed of on those terms without any order as to costs.

Because of the place of supply rule. Hotel accommodation is taxed where the hotel is located, so a Mumbai hotel charges CGST plus Maharashtra SGST even when the guest's employer is registered in Tamil Nadu. Your Tamil Nadu GSTIN can utilise only IGST, CGST and Tamil Nadu SGST, so another state's CGST and SGST is unusable credit; it will appear in your GSTR-2B but must be excluded from the claim. Options are limited: absorb it as cost, or obtain registration in states with heavy recurring stays, which rarely pays. I received a debit note from a supplier for an old invoice. Which year's ITC deadline applies?
