Textile rate increase deferred on the eve of implementation; existing rates continue

46th GST Council Meeting, New Delhi — 31 December 2021 · 2021-12-31

The 46th meeting was convened on the last day of 2021 with essentially one outcome. The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.

Practical effect: Textile traders in Chennai and across Tamil Nadu continued at five per cent from January 2022, but footwear moved to twelve per cent, so the two sectors diverged from that date.

The Madras High Court held that where discrepancies are noticed while scrutinising returns under Section 61, issuing Form GST ASMT-10 is mandatory; however, the absence of an ASMT-10 does not by itself vitiate subsequent proceedings under Sections 73 or 74. On the facts the assessment orders were set aside and remanded so that the taxpayers could file replies and be heard, the Court preferring substantive procedural fairness over a purely technical outcome.

What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
The audit team has pointed out a tax liability. Should I pay it or contest it?
Evaluate each para on its own merits. For findings that are clearly correct, such as missed reverse charge or arithmetic ITC excess, paying through DRC-03 with interest before a show cause notice is issued avoids penalty under Section 73 and closes the para.
