The department demanded interest for delayed payment of tax and attached the taxpayer's bank account without first issuing any show cause notice. The High Court held that issuance of a show cause notice is a mandatory pre-condition before recovery of interest, because the taxpayer must have an opportunity to dispute the period and the computation. The recovery action and the bank attachment were quashed, with liberty to the department to proceed afresh after proper notice.

Refund of tax on advances where the order was cancelled during the pandemic

Circular No. 137/07/2020-GST dated 13 April 2020 · 2020-04-13

CBIC answered questions arising from cancelled bookings and returned goods. Where an advance was received, tax paid and an invoice issued, and the contract was later cancelled, the supplier issues a credit note under section 34 and adjusts the liability; where only a receipt voucher was issued, he issues a refund voucher and claims refund of the excess tax paid in FORM GST RFD-01. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. Claiming it earlier is a premature availment that can be flagged in scrutiny.
