Cumulative credit reconciliation for February to August 2020 in the September return

Circular No. 142/12/2020-GST dated 9 October 2020 · 2020-10-09

As a Covid relief measure, the rule 36(4) credit restriction was not applied separately for each of the tax periods February to August 2020. CBIC clarified that the taxpayer must instead apply the restriction cumulatively for those seven months while filing the GSTR-3B for September 2020, comparing the aggregate credit taken with the aggregate credit reflected in GSTR-2A for that whole span, and reversing any excess in that return.

What to do about it: Any scrutiny of credit for the first Covid year must be tested cumulatively for February to August 2020, not month by month.

Notification

Rule 36(4) rewritten to remove the provisional credit cushion entirely

Notification No. 40/2021-Central Tax · 2021-12-29

The Central Goods and Services Tax (Tenth Amendment) Rules, 2021 substituted Rule 36(4) with effect from 1 January 2022, aligning the rule with the newly enforced clause (aa) of Section 16(2). Credit may now be availed only in respect of invoices or debit notes which the supplier has furnished in its outward supply statement or through the invoice furnishing facility and which have been communicated to the recipient in Form GSTR-2B. The earlier percentage cushion of twenty, ten and then five per cent disappeared completely, so GSTR-2B became the outer limit of admissible credit.

Practical effect: From January 2022 a Chennai business can claim only what its GSTR-2B shows, so supplier follow-up before the return deadline is now the single most important ITC control.

A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Missing the window means remaining under the default reverse charge mechanism for the whole year.
My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. My shop was closed for a month. Can I skip filing GST returns for that period?

How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. How do I round off tax amounts on a GST invoice?
