Buyers were denied ITC because their suppliers were later found non-existent and their registrations cancelled with retrospective effect. The Calcutta High Court remanded the matter, directing the authorities to verify whether the purchases were genuine, supported by valid invoices, made through banking channels, and effected before the cancellation; if the buyers acted in good faith after verifying the suppliers' registration on the portal, the benefit of input tax credit should not be denied to them.

Acting on a Group of Ministers report, the Council cut rates on COVID relief goods until 30 September 2021. Tocilizumab and Amphotericin B moved to nil, while Remdesivir and anti-coagulants such as heparin were reduced to 5 per cent. Medical grade oxygen, oxygen concentrators, ventilators, BiPAP machines, COVID testing kits and specified diagnostic kits all moved from 12 to 5 per cent. Pulse oximeters, hand sanitiser, temperature check equipment and crematorium furnaces moved to 5 per cent, and ambulances from 28 to 12 per cent.

What to do about it: These were temporary rates with a hard expiry, so suppliers must be able to show that concessional invoices fall inside the notified relief period.

GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
What documents do GST audit officers usually ask for?
Expect to produce the GSTR-1, GSTR-3B and GSTR-9 filings for the audit years, audited financial statements, trial balance, sales and purchase registers, ITC ledgers with supplier-wise detail, fixed asset register, e-way bill data, bank statements, key customer and vendor agreements, stock records and reconciliations between books and returns. Officers in Tamil Nadu commonly probe ITC on blocked credits under Section 17(5), reverse charge compliance, classification and rate issues, and turnover differences with income tax filings. Preparing a reconciliation file before submission lets you spot and voluntarily correct issues through DRC-03, which is far cheaper than an audit objection. What happens if I do not reply to an ASMT-10 scrutiny notice?

What discrepancies usually trigger a GST scrutiny notice?
The frequent triggers are: tax declared in GSTR-1 exceeding tax paid in GSTR-3B; ITC claimed in GSTR-3B exceeding credit available in GSTR-2A or GSTR-2B; e-way bill turnover higher than reported outward supplies; missing reverse charge payments on transport, legal or import services; ITC not reversed on exempt supplies under Rules 42 and 43; and mismatches with TDS credits reported by government deductors in GSTR-7. Most of these are explainable through timing differences, credit notes or amendments, provided the reply maps each rupee of difference. Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
My footwear shop sells chappals at Rs.300 and shoes at Rs.4,000 on the same bill. How do I invoice this?
One invoice can comfortably carry both rates. Each pair is tested against the Rs.2,500 sale-value threshold independently, so the chappals are billed at 5% and the Rs.4,000 shoes at 18%, as separate line items under their footwear HSN codes in Chapter 64. Your GSTR-1 HSN summary will then show turnover split across the two rates. Ensure the billing software picks the rate from the item price automatically rather than from a fixed product master, because the same article sold at different price points can legitimately fall in different slabs. Use the GST Self-Service Grievance Redressal Portal at selfservice.gstsystem.in.
