Circular No. 200/12/2023-GST, dated 1 August 2023 · 2023-08-01

Giving effect to the 50th GST Council decisions, CBIC clarified that un-fried and uncooked snack pellets manufactured by extrusion are classifiable under tariff item 1905 90 30 and attract five per cent with effect from 27 July 2023, and that fish soluble paste moved from eighteen to five per cent from the same date. Imitation zari thread or yarn made from metallised polyester or plastic film was placed at five per cent, and past periods were regularised on an as-is basis.

GST Council

All electric vehicles cut to 5 per cent and chargers from 18 to 5 per cent

36th GST Council Meeting (video conferencing) — 27 July 2019 · 2019-07-27

The Council reduced GST on all electric vehicles from 12 per cent to 5 per cent and on chargers or charging stations for electric vehicles from 18 per cent to 5 per cent. Hiring of electric buses with carrying capacity of more than twelve passengers by local authorities was exempted. All these changes took effect from 1 August 2019. The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.

Practical effect: Electric vehicle dealers and charging point operators in Chennai bill at five per cent, a rate that has survived every later rate revision including GST 2.0.

Supreme Court applies the doctrine of mutuality to exempt clubs supplying members

State of West Bengal v. Calcutta Club Ltd — Supreme Court, (2019) 19 SCC 107, judgment dated 03-10-2019 · 2019-10-03

The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.

What to do about it: Chennai clubs, associations and resident welfare bodies cannot rely on mutuality under GST any longer, as the law was amended to override this ruling.

Do I have to report HSN codes in my GSTR-1?
Yes. Taxpayers with aggregate turnover up to Rs.5 crore must report a 4-digit HSN summary for B2B supplies in Table 12 of GSTR-1, while those above Rs.5 crore must report 6-digit HSN codes for all supplies. The portal now validates HSN entries against its master list, so wrong or truncated codes can block filing. The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Can I issue a single credit note against several invoices?
Yes. Since the amendment to Section 34 by the CGST (Amendment) Act, 2018, effective 1 February 2019, the law permits one or more credit notes to be issued against one or more tax invoices of a financial year. A distributor giving a season-end adjustment to a retailer can therefore issue one consolidated credit note covering dozens of invoices, rather than one note per bill. When reporting it in GSTR-1, the portal accepts credit notes without invoice-wise linking for this reason. Maintain a working annexed to the credit note listing the invoices covered, because in scrutiny the officer will ask you to establish the linkage and the arithmetic.
Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. A credit note relating to an invoice of a financial year must be declared in your returns by 30 November following the end of that financial year, or the date of filing the annual return, whichever is earlier. After this date, you can no longer reduce your output tax through a GST credit note for that year's invoices; any adjustment becomes purely commercial with no tax benefit. Sales returns in Koyambedu businesses often surface months later, especially season-end returns from distributors, so sweep your pending returns and disputes each October and issue the credit notes in time.
Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Koyambedu trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
Is there a last date to claim input tax credit for a financial year?
Yes. Under Section 16(4), ITC for invoices and debit notes of a financial year must be claimed by the earlier of 30 November following the end of that financial year or the date of filing the annual return GSTR-9. So credit on a March 2026 invoice must be taken in a GSTR-3B filed on or before 30 November 2026. Credits discovered after this date are permanently lost, which is why a year-end reconciliation in September or October, comparing books, GSTR-2B and GSTR-3B for the full year, is essential for every business in Koyambedu.
What is the late fee for filing GSTR-9 after the due date?
From FY 2022-23 onwards, the late fee is turnover-linked. For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. What is the GST rate for restaurants and food delivery now?
Standalone restaurants, eateries and cloud kitchens charge 5 percent GST without input tax credit. Restaurants located in hotels where the room tariff exceeds Rs.7,500 per day fall in the specified premises category and charge 18 percent with input tax credit. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it. A restaurant in Koyambedu paying 5 percent must remember that GST on its rent, gas and equipment purchases becomes a cost, since credit is barred.
What is the GST treatment for an event management company handling corporate events?
Event management services attract 18 percent with full input tax credit. Place of supply rules deserve attention: for organising an event for a registered client, the place of supply is the client's location, so a Chennai company organising a Goa offsite for a Bengaluru-registered client charges IGST to Karnataka. For unregistered clients, the place of supply is where the event is actually held. Admission tickets are taxed where the event takes place. Getting the state wrong means the client's credit is jeopardised and the tax may need repayment under the correct head, so event companies serving multi-state clients should map each contract before invoicing.
What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST. Goods moved without registration and e-way bills, required for consignments above Rs.50,000, also risk detention. If your turnover has crossed the threshold, registering within thirty days is far cheaper than regularising later.
Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. Retail schemes such as festival discounts and trade margins should always be structured to print on the invoice.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
I hold stock purchased before the September 2025 rate cuts at higher tax rates. What happens when I sell it now?
You charge the rate in force on the date of supply, so goods sold on or after 22 September 2025 carry the new lower rate even if you bought them when the rate was 12% or 28%. The input tax credit you took at the old, higher rate remains fully intact in your credit ledger and is not restricted merely because output is now taxed lower; it simply sets off across your overall liability.
