CBIC again invoked Section 168A to extend the time for passing orders under Section 73(10) to 30 April 2024 for FY 2018-19 and 31 August 2024 for FY 2019-20. The notification has been challenged in several High Courts on the ground that it was issued without a prior GST Council recommendation and without any subsisting force majeure, and the validity question is presently before the Supreme Court, with many demand orders kept alive subject to the outcome.

CBIC clarified that under Rule 88B(3), interest under Section 50(3) arises only where wrongly availed input tax credit has actually been utilised. Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.

Practical effect: When reversing a disputed credit, extract the daily credit ledger balances, since a consistently adequate balance defeats the interest demand entirely.

As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
How will I be informed of the GST audit findings?
On conclusion of the audit, the officer must inform you of the findings, your rights and obligations, and the reasons for the findings in Form ADT-02 within thirty days. Before that, most audit teams share draft observations and seek your response, which is your best window to knock out weak points with documents. If the audit detects unpaid tax or wrongly availed ITC, you can accept and pay through DRC-03, or contest, in which case the department initiates proceedings under Section 73 or Section 74. Treat the draft objection stage seriously; a strong rebuttal there often prevents a show cause notice altogether.
What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.

Expect to produce the GSTR-1, GSTR-3B and GSTR-9 filings for the audit years, audited financial statements, trial balance, sales and purchase registers, ITC ledgers with supplier-wise detail, fixed asset register, e-way bill data, bank statements, key customer and vendor agreements, stock records and reconciliations between books and returns. Officers in Tamil Nadu commonly probe ITC on blocked credits under Section 17(5), reverse charge compliance, classification and rate issues, and turnover differences with income tax filings. Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC.
