Circular No. 245/02/2025-GST · 2025-01-28

Implementing 55th GST Council decisions, CBIC clarified that penal charges levied by banks and NBFCs for breach of loan terms, which replaced penal interest per RBI directions, are not consideration for any service and attract no GST. It also clarified that RBI-regulated payment aggregators are covered by the exemption for settlement of transactions up to Rs 2,000, and addressed other service-tax positions, regularising past periods on an as-is basis.

What to do about it: Borrowers should not accept GST charged on penal charges by lenders, and merchants using payment aggregators get relief on small-ticket settlement charges.

GSTN Advisory dated 14 November 2023 — input tax credit reversal under Rule 37A of the CGST Rules for FY 2022-23 · 2023-11-14

Rule 37A requires a buyer to reverse input tax credit where the supplier reported the invoice in GSTR-1 but did not file the GSTR-3B for that tax period by 30 September following the end of the financial year. The reversal must be made in the GSTR-3B filed on or before 30 November. GSTN made supplier-wise details of such invoices available on the portal and advised taxpayers to complete the reversal for FY 2022-23 by 30 November 2023. The credit can be reclaimed once the supplier files the pending return.

What it means for you: Run a supplier compliance check every October, because credit from a defaulting supplier must be reversed by 30 November or carries interest.

Rule 86B forces one per cent of output tax to be paid in cash

Rule 86B, CGST Rules, 2017, inserted by Notification No. 94/2020-Central Tax · 2020-12-22

Rule 86B, effective 1 January 2021, bars a registered person whose taxable turnover in a month exceeds Rs 50 lakh from discharging more than ninety-nine per cent of the output tax liability for that month from the electronic credit ledger. At least one per cent must come from cash. Exemptions apply where the proprietor, managing director or partners have paid more than Rs 1 lakh as income tax in each of the last two years, or where a large refund has been received on exports or an inverted duty structure.

Why this matters: A Chennai business billing above Rs 50 lakh a month cannot run purely on credit and must budget for a minimum cash outgo each month unless it fits an exemption.

Recipients registered under the composition scheme are excluded from this reverse charge entry. Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. My workshop bills customers for spare parts and labour together. How should GST be charged?
The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. Can I issue a single credit note against several invoices?
Yes. Since the amendment to Section 34 by the CGST (Amendment) Act, 2018, effective 1 February 2019, the law permits one or more credit notes to be issued against one or more tax invoices of a financial year. A distributor giving a season-end adjustment to a retailer can therefore issue one consolidated credit note covering dozens of invoices, rather than one note per bill. When reporting it in GSTR-1, the portal accepts credit notes without invoice-wise linking for this reason. Maintain a working annexed to the credit note listing the invoices covered, because in scrutiny the officer will ask you to establish the linkage and the arithmetic.
How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
Is ITC available on food, catering and canteen expenses for our factory staff?
Section 17(5)(b) blocks credit on food, beverages and outdoor catering, but with two useful exceptions. First, where you use catering as an input for making an outward supply of the same category, such as a caterer subcontracting another caterer, credit is allowed. Second, where providing the facility is obligatory for the employer under any law, credit is allowed; the classic case is a statutory canteen required under the Factories Act for factories employing more than 250 workers. Even then, credit is typically restricted to the cost borne by the employer, not amounts recovered from employees. Factories around Madipakkam should keep the statutory obligation documented in their credit file.
We distribute free samples and run buy-one-get-one offers. How is ITC treated on these?
The two are treated very differently. Goods disposed of as gifts or free samples attract the block under Section 17(5)(h), so ITC on inputs used for genuinely free samples must be reversed. Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. Getting this right decides whether you charge CGST plus SGST or IGST, and a Madipakkam seller delivering to a Bengaluru buyer charges IGST because delivery terminates in Karnataka.

Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed. Choose the transfer-from head and amount, choose the transfer-to head, add the details to the table, preview and file with DSC or EVC. The transfer reflects in the ledger immediately and an ARN is generated for your records. There is no limit on how often PMT-09 can be filed, and no government fee applies, so it is always the first fix for a wrong-head deposit.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Madipakkam buying stationery from an unregistered shop has no Section 9(4) liability at all.
