The original blanket exemption for renting a residential dwelling

Entry 12, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

As originally notified, Entry 12 exempted renting of a residential dwelling for use as residence, without any condition about who the tenant was. From 1 July 2017 to 17 July 2022 a house or flat let out for residential use carried no GST, whether the tenant was an individual, a firm or a company. The entry was narrowed with effect from 18 July 2022 so that the exemption no longer applies where the tenant is a registered person.

What it means for you: For rent periods up to 17 July 2022 a Chennai landlord had no GST liability on residential letting, which is a useful defence if an old notice questions those years.

Circular No. 136/06/2020-GST dated 3 April 2020 · 2020-04-03

CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
What happens if I miss filing GSTR-3B this month?
A late fee of Rs.50 per day (Rs.20 per day for a nil return) accrues automatically, capped based on your turnover, and interest at 18 percent per annum applies on tax paid late. You also cannot file the next period's GSTR-1 until the pending GSTR-3B is filed, since returns must be filed sequentially. If two consecutive tax periods remain unfiled, e-way bill generation gets blocked, and continued default can lead to suspension of your GSTIN. Our institute charges one fee covering classes, study material and hostel. How is it taxed?
A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. For a coaching institute, coaching is the principal supply, so the entire lump sum, including printed materials and boarding provided as part of the package, attracts 18 percent. Printing separate invoices for books at nil rate out of a bundled fee is a known audit red flag and is routinely rejected. If the institute genuinely sells optional printed books to anyone at a separate price, those standalone sales can take the book's own treatment. Structure the fee schedule deliberately, not after the demand arrives.
Is there a late fee for filing GSTR-1 after the 11th?
Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Although the portal historically collected GSTR-1 late fees through the next GSTR-3B, the liability arises the moment the due date passes. Delayed GSTR-1 also hurts your customers, because your invoices miss their GSTR-2B and their input tax credit gets deferred, which can strain business relationships. Filing by the 11th every month avoids both the cost and the friction.
How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
My turnover is Rs.1.2 crore. Is GSTR-9 compulsory for me?
No. For taxpayers with aggregate turnover up to Rs.2 crore, filing GSTR-9 has been made optional through CBIC notifications, and this relaxation has been continued year on year. If you do not file by the due date, the return is deemed furnished. That said, many businesses in Madipakkam still choose to file voluntarily because the exercise reconciles the year's GSTR-1, GSTR-3B, books and GSTR-2B, and surfaces excess credit claims or unreported liability before the department finds them. Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Madipakkam trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
What is the late fee for filing GSTR-9 after the due date?
From FY 2022-23 onwards, the late fee is turnover-linked. For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. The fee accrues until the date of filing, so delays get expensive for larger businesses. Filing before 31 December avoids the entire cost.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.
Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Supermarkets and pharmacies with mixed inventories use this format daily, and billing software handles the split automatically once configured.
Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. A mason team building one independent house in Madipakkam on labour-only terms therefore charges no GST, but the same team working on an apartment project must.
What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
