A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Why this matters: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

CBIC explained the implementation of the retrospective ITC relaxations: for FY 2017-18 to 2020-21, credit claimed in GSTR-3B filed up to 30 November 2021 is valid, and taxpayers with confirmed demands on this sole ground must use the special rectification procedure rather than appeals where the order was not contested. It also clarified, following Section 150 of the Finance (No. 2) Act, 2024, that no refund arises for tax already paid or credit already reversed on this issue.

Why this matters: The 16(4) relief works only prospectively against pending or unpaid demands; amounts already paid or reversed cannot be recovered as refunds, so prioritise open cases.

The Supreme Court held that mobile telecom towers and prefabricated shelters are not immovable property. They are fixed to the earth only for stability, can be dismantled and relocated without damage, and are therefore intrinsically movable goods. Consequently they qualify as capital goods or inputs and CENVAT credit on them is allowable. The reasoning on the movable versus immovable test is regularly applied to input tax credit disputes under GST as well.

For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity.
