For supplies received from unregistered persons that are taxable under reverse charge, CBIC clarified that the Section 16(4) time limit for availing input tax credit is reckoned from the financial year in which the recipient issues the self-invoice, not the year of the supply itself. Where the self-invoice is issued belatedly, the recipient may still claim credit but is liable to interest for delayed tax payment and possible penal action for the documentation delay.

M/s. Ajay Agency v. State Tax Officer — Madras High Court, W.P. No. 8507 of 2023, decided 30 March 2023 (Anita Sumanth J.) · 2023-03-30

A consignment of power weeders was intercepted on 6 March 2023 at about 10.30 a.m., the e-way bill having expired at 11.59 p.m. the previous night. The taxpayer pleaded a vehicle breakdown. The Court declined to interfere, noting that the validity could have been extended within the permitted window and had not been, and that the officer's decision to detain and penalise under Section 129(1) was not unreasonable. The writ petition was dismissed with liberty to file a statutory appeal.

Practical effect: Chennai transporters must extend e-way bill validity within the permitted window when a vehicle breaks down; the High Court will not excuse an expired bill merely because of a breakdown.

Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.

What to do about it: If you settled a GST demand through DRC-03, file DRC-03A at once so the liability register closes and no recovery notice follows.

DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Verify the computation, pay only what is truly due, and contest the balance in Part B with reasons. ChennaiGST routinely trims DRC-01A figures for clients before payment.
Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected. I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Manali cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST. Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. UHT milk, pre-packaged paneer and all Indian breads such as roti, chapati and paratha became nil rated. Aerated and caffeinated beverages, by contrast, went to the 40% demerit rate. Grocery and supermarket billing masters needed a near-complete refresh from that date, and old stock is simply sold at the new rate applicable on the date of supply.
What are the current GST rate slabs after the GST 2.0 changes?
From 22 September 2025, following the 56th GST Council meeting, India moved to a simplified two-slab structure: a merit rate of 5 percent and a standard rate of 18 percent. The earlier 12 percent and 28 percent slabs were abolished. A special 40 percent rate applies to a short list of luxury and demerit goods, while the concessional rates of 3 percent on gold and silver and 0.25 percent on rough diamonds continue.
