Section 107 of the CGST Act allows an appeal within three months, extendable by one further month. The appellate authority rejected an appeal filed beyond that outer period. The Division Bench held that Section 107 does not expressly exclude the Limitation Act, 1963, and therefore Section 5 of that Act remains available, permitting the appellate authority to condone delay beyond the statutory one month where sufficient cause is shown. The appeal was restored for hearing on merits.

Practical effect: A GST appeal filed slightly beyond four months is not automatically dead — a well-supported condonation application relying on this judgment is worth filing before writing off the demand.

Circular No. 169/01/2022-GST · 2022-03-12

The Board amended its earlier instruction on proper officers so that show cause notices issued by the Directorate General of GST Intelligence are adjudicated by specified Additional or Joint Commissioners of designated Commissionerates. Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant.
