A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.
Practical effect: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.
Notification No. 22/2019-Central Tax dated 23.04.2019 · 2019-04-23
This notification appointed a date for rule 138E of the CGST Rules to come into force. Rule 138E bars generation of Part A of the e-way bill in respect of a registered person who has not furnished returns for two consecutive tax periods, or, in the case of a composition taxpayer, for two consecutive quarters. The commencement date was subsequently deferred more than once before the blocking facility was actually activated on the portal.
What it means for you: A Chennai business that falls two return periods behind will find e-way bill generation blocked, which halts dispatches until the pending returns are filed.
32nd GST Council Meeting, New Delhi — 10 January 2019 · 2019-01-10
The Council created two threshold limits for exemption from registration and payment of GST for suppliers of goods, Rs 40 lakh and Rs 20 lakh, and gave states a week to choose which limit would apply in their territory. The threshold for service providers was left unchanged at Rs 20 lakh, and at Rs 10 lakh for special category states. The change was made operational from 1 April 2019 and remains the basic registration test for traders and manufacturers today.
Practical effect: A Chennai trader dealing only in goods crosses the registration line at Rs 40 lakh of aggregate turnover, but a service provider must register at Rs 20 lakh.
