Tamil Nadu Labour Welfare Board - AAR Tamil Nadu, advance ruling reported August 2021 · 2021

The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.

Practical effect: Chennai landlords letting premises to government offices must charge GST unless a specific exemption entry clearly covers the letting.

This circular amends and supplements the earlier warranty circular. It extends the treatment from replacement of parts to replacement of goods or their parts, so that a full product replacement under warranty is covered on the same basis, with no GST and no credit reversal. It also addresses the position where a distributor replaces goods out of its own stock and is later replenished by the manufacturer, and the treatment of extended warranty sold separately after the original supply.

Notification No. 22/2019-Central Tax (Rate) dated 30.09.2019 · 2019-09-30

This notification added renting of a motor vehicle designed to carry passengers, where the cost of fuel is included in the consideration, to the services reverse charge list with effect from 1 October 2019. The liability falls on a body corporate recipient located in the taxable territory where the supplier is not a body corporate. The entry was refined at the end of 2019 to make clear that it applies only where the supplier does not opt to charge 12 per cent with input tax credit.

What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. Such invoices must be reported individually in Table 5 of GSTR-1 with the place of supply, instead of being merged into the consolidated B2C summary. The rule helps states track high-value consumer sales flowing across borders. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. A credit note relating to an invoice of a financial year must be declared in your returns by 30 November following the end of that financial year, or the date of filing the annual return, whichever is earlier. After this date, you can no longer reduce your output tax through a GST credit note for that year's invoices; any adjustment becomes purely commercial with no tax benefit. This is a bill-to ship-to transaction under Section 10(1)(b). A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
