CBIC explained the implementation of the retrospective ITC relaxations: for FY 2017-18 to 2020-21, credit claimed in GSTR-3B filed up to 30 November 2021 is valid, and taxpayers with confirmed demands on this sole ground must use the special rectification procedure rather than appeals where the order was not contested. It also clarified, following Section 150 of the Finance (No. 2) Act, 2024, that no refund arises for tax already paid or credit already reversed on this issue.
Practical effect: The 16(4) relief works only prospectively against pending or unpaid demands; amounts already paid or reversed cannot be recovered as refunds, so prioritise open cases.

The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.

Goods were detained and penalised because Part B of the e-way bill had not been filled in, although the tax invoice and Part A carried all the required details and there was no dispute about the goods or their value. The High Court held that non-filling of Part B, without any material showing an intention to evade tax, is a technical breach that does not attract penalty under Section 129. The penalty was set aside and refund of the deposit directed.
Practical effect: For a Part B omission with correct invoices, argue absence of intent to evade — the Section 129 penalty is usually not sustainable on those facts.
