Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.

An SEZ unit had accumulated unutilised IGST credit distributed to it by its Input Service Distributor. The refund was rejected on the ground that Rule 89 permits only the supplier to SEZ to claim refund. The High Court allowed the refund of about Rs. 99 lakh, holding that where an ISD has already distributed the credit there is no supplier who can claim it, and that a circular cannot override Section 54 of the CGST Act to leave the credit permanently stranded.
Why this matters: If credit is genuinely stuck with no other route to recover it, a rigid reading of the refund rules or a circular is not a valid ground for rejection.

The applicant promoted courses of foreign universities in India and recruited students for them, receiving commission in foreign exchange. It claimed the service was an export and therefore zero rated. The West Bengal Authority for Advance Ruling, affirmed on appeal, held that the applicant merely facilitates admission of students to the university and is an intermediary under Section 2(13) of the IGST Act. As the place of supply of an intermediary is the location of the supplier, the service is a domestic supply liable to GST.
