Tvl. Ponnian Jaya Singh v. Assistant Commissioner, Kuzhithurai Assessment Circle — Madras High Court (Madurai Bench), W.P.(MD) No. 24482 of 2025, decided 9 September 2025 (G.R. Swaminathan J.) · 2025-09-09

The Madras High Court quashed a cancellation order because it travelled beyond the grounds set out in the show cause notice and because the punishment was disproportionate to the default. The Court held that cancelling a registration should be a measure of last resort and that the authority must first explore less drastic alternatives. The registration was restored, with liberty to the dealer to file returns and reply to the show cause notice for fresh adjudication.

Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Oragadam as urgent.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax.
