A trader erroneously filed nil GSTR-3B returns although its GSTR-2A and annual returns reflected eligible input tax credit, and the assessing officer rejected the ITC solely for non-claim in GSTR-3B. The Madras High Court held that where a registered person asserts eligible ITC, the officer must examine the claim on merits against the supporting documents, and cannot reject it purely because the credit was not reflected in GSTR-3B. The assessment orders were quashed and remanded.

CBIC explained the scope of the phrase 'regularised on as is where is basis' used when the Council settles a disputed rate or classification. Where taxpayers paid at the lower of two competing rates or claimed an exemption in good faith, the past position is accepted as full discharge and no differential demand arises. What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.
What is the difference between GST return scrutiny and a departmental audit?

Should I claim a refund of my accumulated ITC or just carry it forward?

Yes. What is the difference between a GST credit note and a commercial credit note?
A GST credit note is issued under Section 34, is reported in GSTR-1, and reduces your output tax, with the buyer reversing equivalent input credit. A commercial or financial credit note adjusts only the money owed between the parties; it carries no GST, is not reported in returns, and leaves everyone's tax position untouched.
