The late fee payable for delay in furnishing Form GSTR-4 for the financial year 2021-22 was waived where the return was filed between 1 May 2022 and 30 June 2022, a window later extended to 28 July 2022. The relief was given because a large number of composition taxpayers had not appreciated that GSTR-4 had become an annual return, and had also faced difficulty with the negative liability entries that the portal was generating in the composition ledger.

Why this matters: Chennai composition dealers could file the 2021-22 annual return free of late fee up to 28 July 2022, and any fee levied for that year within the window is refundable.

First set of clarifications on the Covid-19 compliance relief package

Circular No. 136/06/2020-GST dated 3 April 2020 · 2020-04-03

CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

What to do about it: Interest and late fee demands for the early 2020 periods must be tested against these concessional rates before they are paid.

The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
How do I handle GST when expired medicines are returned to the distributor?
CBIC Circular 72/46/2018 gives two routes for time-expired drugs. The return can be treated as a fresh supply by the person returning them, with a tax invoice if that person is registered, or the original supplier can issue a credit note under Section 34; the tax adjustment on a credit note is available only if it is reported within the statutory window, now 30 November following the financial year of supply. Where the manufacturer ultimately destroys the expired stock, input tax credit relating to the destroyed goods must be reversed under Section 17(5)(h). I made a mistake in GSTR-3B. Can I revise it?
No, GSTR-3B cannot be revised once filed. The GST law allows corrections only through adjustments in the returns of subsequent tax periods. If you under-reported tax, pay the difference with 18 percent interest in the next GSTR-3B or through Form DRC-03. If you over-reported, adjust it in a later month within the time limits allowed. I received a debit note from a supplier for an old invoice. Which year's ITC deadline applies?
The deadline is counted from the date of the debit note, not the original invoice. After the Finance Act 2020 delinked debit notes from their underlying invoices, ITC on a debit note can be claimed up to 30 November following the end of the financial year in which the debit note itself was issued. So a debit note dated June 2025 against an invoice of January 2024 remains claimable until 30 November 2026. This delinking rescues many price-escalation and rate-difference credits that would otherwise appear time-barred, and it is worth checking before writing off any debit note credit as lost.
What is the difference between GSTR-2A and GSTR-2B, and which one should I follow?
GSTR-2A is a dynamic statement that keeps changing as suppliers file or amend their returns, so the same month's data can look different on different dates. GSTR-2B is a static statement generated on the 14th of each month, capturing supplier filings between cut-off dates, and it never changes afterwards. The law ties your ITC eligibility to GSTR-2B, and GSTR-3B auto-populates from it, so 2B is the statement to reconcile against for monthly claims. GSTR-2A remains useful for tracing when an invoice was actually uploaded, which helps in replying to departmental queries about earlier periods.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Oragadam architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. I deposited money under the wrong head in my GST cash ledger. Why can the amount not be used?
The cash ledger is divided into major heads, IGST, CGST, SGST and cess, and minor heads, tax, interest, penalty, fee and others. An amount deposited under one combination, say CGST-penalty, cannot be directly used to pay under another, say IGST-tax, which is why your balance appears unusable despite money lying in the ledger. The remedy is Form PMT-09, which transfers the amount to the correct head instantly without any officer approval.
