Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.

How we apply it: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.

Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04

The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

Practical effect: Chennai hostel and paying guest operators should not assume exemption; the outcome turns on the exact facts and on later High Court rulings.

Council decides to introduce electronic invoicing for B2B supplies in phases

35th GST Council Meeting, New Delhi — 21 June 2019 · 2019-06-21

At the first meeting chaired by Finance Minister Nirmala Sitharaman, the Council decided to introduce an electronic invoicing system in a phase-wise manner for business-to-business transactions. The press release recorded that e-invoicing would help taxpayers with backward integration and automation of tax-relevant processes and would help authorities combat evasion, with Phase 1 proposed to be voluntary and rolled out from January 2020. This decision is the origin of the Invoice Registration Portal, the IRN and the QR code now mandatory for most mid-sized and large businesses.

The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. Since auto components also moved to 18% from September 2025, both lines of a typical job card now carry the same rate, which removes the old temptation to shift value between parts and labour. How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
What is the 180-day payment rule for input tax credit?
Under the second proviso to Section 16(2) read with Rule 37, if you do not pay your supplier the invoice value including tax within 180 days from the invoice date, you must reverse the proportionate ITC in GSTR-3B, along with interest at 18 percent per annum from the date of availment. The credit can be re-availed, without any time limit, once payment is actually made. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
My supplier issued a credit note against an earlier invoice. What must I do with the ITC?
When a supplier issues a credit note reducing the taxable value or tax, you must correspondingly reverse the proportionate ITC you had claimed on the original invoice, since the supplier's output liability reduces only when your credit reduces. The credit note flows into your GSTR-2B as a negative entry, and your GSTR-3B claim should net it off in the same period. With the Invoice Management System introduced on the portal from October 2024, you can accept, reject or keep pending supplier documents, and your action on a credit note directly shapes your GSTR-2B. Reconcile purchase returns, rate differences and discount credit notes monthly so reversals never lag behind.
What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. Litigation-heavy businesses in Padi should reconcile their legal expense ledger against RCM paid every quarter.
Can I reduce GST for discounts given after the sale, like turnover incentives?

This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.
What is the GST treatment for an event management company handling corporate events?
Event management services attract 18 percent with full input tax credit. Place of supply rules deserve attention: for organising an event for a registered client, the place of supply is the client's location, so a Chennai company organising a Goa offsite for a Bengaluru-registered client charges IGST to Karnataka.
