Tamil Nadu Labour Welfare Board - AAR Tamil Nadu, advance ruling reported August 2021 · 2021

The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.

What it means for you: Chennai landlords letting premises to government offices must charge GST unless a specific exemption entry clearly covers the letting.

GST 2.0 exemption list: UHT milk, paneer and Indian breads made nil-rated

Notification No. 10/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

Superseding the 2017 exemption notification, this list re-notifies all nil-rated goods with effect from 22 September 2025 and widens it significantly. Ultra-high temperature milk became exempt, chena and paneer became exempt whether or not pre-packaged and labelled, and all Indian breads including roti, chapathi, paratha, parotta, khakhra and pizza bread were exempted by name. Pencils, crayons, sharpeners, slates, maps, globes and exercise books were also brought to nil.

What it means for you: Dairy shops and bakeries in Chennai now bill paneer and parotta at nil, but must remember that exempt turnover blocks the corresponding input tax credit.

The department demanded interest on the entire tax shown in belated GSTR-3B returns, including the part discharged from input tax credit. The Madras High Court held that interest under Section 50 is compensatory, and can be levied only on the belated cash payment of tax, not on input tax credit that was lying with the department all along. The proviso inserted in Section 50(1) was treated as curative and applicable to earlier periods as well.

Why this matters: A Chennai business that filed GSTR-3B late should verify that any interest demand is computed only on the cash component of the tax, and contest interest charged on the ITC-set-off portion.

How should I raise invoices on foreign clients and report them in my returns?
You may invoice in foreign currency, but your GST records must state the value in rupees. An export invoice under LUT should carry the endorsement that the supply is meant for export under Letter of Undertaking without payment of integrated tax, along with your GSTIN, SAC code and the recipient's overseas address. In GSTR-1, these invoices go into Table 6A marked without payment of tax, and the turnover flows into GSTR-3B as zero-rated supplies. Match every invoice to a FIRC or bank credit. You do. Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. Who has to file the GSTR-9 annual return?

Is there a last date to claim input tax credit for a financial year?
Yes. Under Section 16(4), ITC for invoices and debit notes of a financial year must be claimed by the earlier of 30 November following the end of that financial year or the date of filing the annual return GSTR-9. What details must a GST tax invoice compulsorily contain?
Rule 46 of the CGST Rules prescribes the mandatory contents: your name, address and GSTIN; a consecutive serial number not exceeding sixteen characters, unique for the financial year; the date of issue; the recipient's name, address and GSTIN if registered; the HSN or SAC code; description, quantity and unit; total and taxable value; any discount; the rate and amount of CGST, SGST or IGST shown separately; place of supply with the state name for inter-state supplies; a declaration where tax is payable on reverse charge; and signature or digital signature of the supplier. Missing fields make the invoice defective and can jeopardise your buyer's credit.
Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Padi godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
What is the default place of supply rule for services within India?
Section 12(2) of the IGST Act sets the general rule for domestic services: if the recipient is registered, the place of supply is the recipient's location; if unregistered, it is the recipient's address on your records, and failing that, the supplier's own location.
