Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
How we apply it: The late fee waiver here is conditional: if the GSTR-3B was not filed by the notified date, late fee runs from the original due date, so the actual filing date decides whether any waiver survives.

The Chairperson offered a compromise between a fixed 13 per cent growth rate, an average of three of the preceding five years' growth after removing the highest and lowest, and a 14 per cent rate pressed by Kerala and Assam. The Council unanimously agreed that projected State revenue for compensation purposes would grow at a flat 14 per cent per year from the 2015-16 base, with CST in that base counted at the actual 2 per cent. This single number determined the size of the compensation bill for the five-year guarantee period and, when actual GST collections fell short of it, drove the compensation cess extensions and the back-to-back borrowing arrangements of later years.
What to do about it: The 14 per cent guarantee is the reason compensation cess outlived its original five-year sunset, so cess-bearing goods remain costlier than the headline GST rate suggests.
Westinghouse Saxby Farmer Ltd v. Commissioner of Central Excise, Calcutta — Supreme Court, AIR 2021 SC 1409, judgment dated 08-03-2021 · 2021-03-08
The Supreme Court held that relays manufactured solely for use in railway signalling equipment were classifiable under the chapter covering railway goods rather than the general electrical apparatus chapter. It applied the relevant section note treating parts suitable for use solely or principally with a particular article as classifiable with that article. The judgment illustrates that classification turns on the statutory notes and the predominant use of the item.
What it means for you: A Chennai manufacturer classifying components should examine the section and chapter notes, as sole or principal use can shift the heading and the GST rate.
