Invoices had been raised showing the GSTIN of a group company instead of the actual recipient, which prevented the recipient from claiming credit. The High Court held the mistake was bona fide and inadvertent, applied Circular No. 183/15/2022-GST, and directed the authorities to permit rectification of the invoices and the corresponding returns for 2017-18 and 2018-19, and extended the same benefit to 2019-20 taking a justice-oriented approach.
Practical effect: A wrong GSTIN or similar clerical error in old invoices is not necessarily fatal — a rectification request supported by this judgment and Circular 183 is worth pursuing.
Notification No. 10/2017-Integrated Tax (Rate) dated 28.06.2017 · 2017-06-28
This notification lists the services on which the recipient, rather than the supplier, must pay integrated tax. Its most-used entry covers any service supplied by a person located outside India to a person located in India, which is how imported software subscriptions, foreign consultancy and overseas advertising are taxed. It also contained the ocean freight entry that the Supreme Court later struck down. Tax paid under this notification is paid in cash and then claimed as input tax credit if the recipient is otherwise eligible.
What it means for you: A Chennai company paying a foreign vendor for software, design or marketing services must self-pay IGST under this notification in the month of payment or invoice, whichever is earlier.

Faced with widespread filing difficulties, the Council approved a revised schedule for the first tax period: GSTR-1 for July 2017 to 10 October (3 October for taxpayers above Rs 100 crore turnover), GSTR-2 to 31 October, GSTR-3 to 10 November and GSTR-6 to 13 October. Table 4 of GSTR-4 was not to be filled for the July-September quarter and GSTR-4A was dispensed with. GSTR-3B was to continue for August to December 2017.
Why this matters: The invoice-matching return cycle of GSTR-1, 2 and 3 collapsed almost immediately, and GSTR-3B became the permanent monthly filing every Chennai business now does.
