The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

Practical effect: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

Food delivery platforms to pay the GST on restaurant service from January 2022

Circular No. 167/23/2021-GST dated 17 December 2021 · 2021-12-17

Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.

Implementing the Finance Act, 2023 amendments to Sections 37, 39, 44 and 52, notified by Notification No. 28/2023-Central Tax, GSTN advised that from the July 2025 tax period the portal blocks filing of GST returns once three years have passed from their due date. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. What is the 180-day payment rule for input tax credit?
Under the second proviso to Section 16(2) read with Rule 37, if you do not pay your supplier the invoice value including tax within 180 days from the invoice date, you must reverse the proportionate ITC in GSTR-3B, along with interest at 18 percent per annum from the date of availment. The credit can be re-availed, without any time limit, once payment is actually made.
