CBIC clarified that where a manufacturer replaces parts or provides repair services free of cost during the warranty period, no further GST is payable because the value of the warranty was already included in the price of the original supply on which tax was paid. Consequently the manufacturer need not reverse input tax credit on such replacement parts. A penalty order demanding tax with 200 per cent penalty was passed because the company operated an additional place of business that had not been added to its registration. The Madras High Court quashed the penalty, finding it harsh on the facts: the invoice and e-way bill had been generated before the seizure, and the failure to register the extra premises was a technical and venial breach rather than a deliberate attempt at evasion.

Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering.
