CBIC explained the newly inserted rule 36(4). The restriction is not supplier-wise but is computed on a consolidated basis for all invoices not appearing in GSTR-2A. The amount of eligible credit is determined from GSTR-2A as on the due date for filing GSTR-1 by suppliers for that month. A taxpayer may therefore claim only twenty per cent more than the credit reflected in GSTR-2A, and the balance may be claimed in a later month once the supplier uploads the invoice.
What to do about it: This circular began the era of credit being tied to supplier filings, and monthly reconciliation of purchases with GSTR-2A or 2B is now unavoidable.

On 31 December 2021, the same day as the 46th GST Council meeting convened at the instance of Tamil Nadu and other States, the Government superseded the November notification. The proposed increase on textiles was dropped, so fabrics, yarn, garments and made-ups continued at five per cent, but the footwear change survived and all footwear became taxable at twelve per cent from 1 January 2022 irrespective of price. The value threshold that had earlier kept cheap footwear at five per cent disappeared.
What to do about it: From January 2022 to September 2025 every pair of footwear attracted twelve per cent regardless of price, and rate mistakes in that window are a common scrutiny point.

The Supreme Court examined contracts for supplying cranes, tankers and vehicles to ONGC. It held that a transfer of the right to use goods requires the customer to obtain effective control and legal right to use the goods to the exclusion of the owner. Where the owner retains the operator, control and responsibility, the arrangement is a service contract and not a deemed sale. Sales tax or VAT was therefore not attracted; service tax was.
